California Domestic Worker Bill of Rights

Recently, California Governor Jerry Brown signed AB 241, the Domestic Worker Bill of Rights, into law effective January 1, 2014. Originally the bill included provisions for overtime, off-duty meal breaks and a 30-day notice of termination.

The off-duty meal breaks and 30-day termination notices were struck from the final bill. However, the new law stipulates that all domestic employees in California will be entitled to overtime.

The specific overtime requirements will vary depending on the type of worker. For most families, the following overtime stipulations will apply to their employment situation.

 

Personal Attendants (nannies, baby nurses, senior caregivers, etc.)

 

  • Live-Out – Overtime is required if the employee works more than 9 hours in a day and/or 40* in a 7-day workweek.

 

  • Live-In – Overtime is required if the employee works more than 9 hours in a day and/or 45 hours in a 7-day workweek.* Federal law governed by the Fair Labor Standards Act (FLSA) entitles all live-out domestic workers to overtime rates for all hours worked over 40 in a workweek. Therefore, the weekly overtime threshold of 45 hours mandated in AB 241 is only applicable to live-in personal attendants.

 

All Other Domestic Workers (housekeepers, personal assistants, chefs, estate managers, etc.)

 

  • Live-Out – Overtime must be paid to the employee if they work more than 8 hours in a day and/or 40 in a 7-day workweek.

 

  • Live-In – Overtime is required if the employee works more than 9 hours in a day.

 

NOTE: There are additional overtime requirements for employees that work 12 or more hours in a day or 6 or 7 consecutive days in a workweek. Please call our office for details if this employment situation arises for you.

 

Financial Illustrations of the Cost Impact to Employers

Not all families with overtime situations will be impacted by these changes. If a family employs a nanny 5 days per week and she works 10 hours per day, her payroll will not change:

2013 Wages                                      2014 Wages
Hourly Rate = $16/hr                      Hourly Rate = $16/hr
Regular Hours Worked = 40          Regular Hours Worked = 40
Overtime Hours Worked = 10       Daily Overtime Hours = 5
Additional Overtime Hours = 5

Total = $880                                     Total = $880
(40 X $16) + (10 X $24)                   (40 X $16) + (5 X $24) + (5 X $24)

However, if the same family employs a nanny 3 days per week and she works 11 hours per day, her payroll will be affected by the 2 additional hours of daily overtime each day she works:

2013 Wages                                     2014 Wages
Hourly Rate = $16/hr                     Hourly Rate = $16/hr
Regular Hours Worked = 33         Regular Hours Worked = 27
Overtime Hours Worked = 0        Daily Overtime Hours = 6

Total = $528                                    Total = $576
(33 X $16)                                        (27 X $16) + (6 X $24)

It’s time to celebrate your nanny! National Nanny Recognition Week is next week! This is a special week set aside every year to honor your nanny and show her how much you appreciate everything she does for your family. It’s a time for your children to show gratitude to their nanny for being such a positive role model. Remembering to say “Thank you” to your nanny throughout the year is so important, and here are some ways to make her feel extra fabulous next week!

1. CREATIVE APPRECIATION

If your children are musical, have them sing a song (or write a poem) to thank your nanny. It will make her smile and it’s super creative for the kids to write their own lyrics.

2. DRAW A THANK YOU CARD

Are your children great artists? Have them create a special thank you card for your nanny.

3. PAMPER YOUR NANNY

Is your nanny working 10 hour days? Gift your nanny a relaxing day at the spa or treat her to a massage.

4. GIFT OF EDUCATION

Has your nanny always wanted to take a special class to add to her list of skills or learn another language? Sponsor her to attend the International Nanny Association conference, take a cooking class, or purchase Rosetta Stone in her language of choice.

5. BONUS

Tell your nanny how much you appreciate her, and then gift her a bonus or a health insurance stipend to contribute to her well-being.

6. WORDS OF KINDNESS

Simply say thank you and tell your nanny how wonderful she is. It feels good to be loved and hear positive things!

7. PAID DAY OFF

Treat your nanny to a paid day off. Many nannies work long hours, so they will really appreciate finding the time to visit the dentist, get a haircut, or treat them to a mani/pedi. Feeling polished is a win/win for everyone 🙂

8. THROW A NANNY PARTY

Decorate the house, make some cupcakes, put on your nannie’s favorite music, and celebrate her awesomeness!

9. DINNER AT HER FAVORITE RESTAURANT

Many times nannies spend hours preparing meal plans for the week, grocery shopping, and cooking delicious meals. Treat your nanny to a night off from cooking and send her out to her favorite restaurant.

10. MAKE A DONATION 

Do you already spoil your nanny and treat her like part of the family? Maybe there is a cause that is near and dear to your nannie’s heart? You and the kids could donate your time or make a kind donation? Get creative and think outside of the box!

Nanny Tip of the Week! Back to School means it’s time to pack snacks and lunches again. It’s a great time to get all of the children involved during or after breakfast. Set out five different healthy snacks and let them choose their top two or three. Write a sweet note with something positive such as, “Have fun learning with your friends!” and add it to the snack pack. The children will look forward to it, and it’s a great way for them to practice reading. If you have a teenager, substitute a note with a text message during lunch time that says, “You’re awesome!” It doesn’t require a reply and it will make them smile.

Nanny Tip of the Week! It’s Back-to-School time, so it’s a wonderful opportunity to show off your organizational skills. Sew in labels to the children’s clothing, color code events in the family calendar, offer to go get the mini van washed, create “sport sacs” for each child with all of their necessary clothing and equipment, label the pantry and stock up on snack foods and fruits from the farmer’s market. Make sure your cell phone is updated with all the necessary contact numbers and play date information. If you really want to make an impression, as a thank you to the parents for taking you on vacation this summer or for paying you the weeks you had off while they were out of town, offer them a complimentary date night in August 🙂
